From what I know so far, it is mandated by the State of Mississippi that it is illegal to operate motor vehicles, motorcycles, mopeds or golf carts on Mississippi roadways without liability insurance coverage. Apparently too, it is also illegal for any motor vehicle owner to allow anyone else to drive the vehicle without insurance.

There are prescribed minimum mandatory insurance coverage for the State of Mississippi as 25/50/25. This means: $25,000 bodily injury for one person in one accident, $50,000 for two or more persons in one accident, and $25,000 property damage incurred in one accident.

If a violation or an accumulation of violations, such as reckless driving, driving under the influence (DUI) or (DWI), or refusal to test, at fault accidents or driving without insurance will be committed by a driver in Mississippi, the state’s DMV will mandate proof of financial responsibility in the form of SR-22 insurance. This insurance is also known as high-risk auto insurance for some SR22 filing companies in Jackson, MS.

When I purchased full coverage auto insurance in Gulport Mississippi, my understanding was that if my car was totaled in an accident, that means my car loan would be paid off. I was very disappointed to know from my insurance company that they’re only going to pay my car’s market value after it was totaled. Is that fair?

I know that it’s disappointing but in reality your insurer is not obligated to pay you the amount you still owe on your car loan after it was totaled. Actual cash value refers to the amount the car was worth before the accident. Therefore, you’re still responsible for the amount outstanding on your car loan.

There is a way for you to cover the difference between the car’s cash value and the amount you owe on the loan and that is to purchase gap insurance. Gap insurance covers you if your car is totaled before you’ve paid off the loan, or before the lease term is expired. It is available to cover auto leases and auto loans.
